BECOME A FOSTER FAMILY!

Becoming a foster family, is about providing a child with a stable family environment, protecting his or her well-being and defending his or her interests. 

It is to offer a child a secure bond of attachment that allows him to grow in the best conditions and to evolve at his own pace.

It means respecting the individuality of the child, his or her background, parents and family system of origin.

It is to contribute to the respectful development of the child's needs.

 

Profile of the candidates

Future foster care candidates will need to be emotionally stable and demonstrate interpersonal skills.

  • They know themselves well; they are aware of their strengths and limitations and their emotional world.
  • They think positively about life and are resource-oriented.
  • They have family and parental resources.
  • They are able to challenge themselves, and adapt their educational style to the needs of the child.
  • They understand the situation of the parents of origin, the context and the scope of the reception.
  • They accept, value and encourage links between the child and his or her family of origin.
  • They meet with the parents of origin in an atmosphere of respect and refrain from judgment.
  • They accept shared parenting.
  • They are open to collaboration with the actors involved in the foster care system. 

Conditions of approval

To practice the activity of socio-educational foster care, the foster family must be able to :

  • Offer a suitable place to live and offer the appropriate care to the children being cared for ;
  • Respect the number of children and the modalities authorized by the agreement (max. 4 children simultaneously unless otherwise stated);
  • Have a infrastructure that meets the minimum criteria such as :
      •  provided for in Article 27 of the amended Grand Ducal Regulation of August 17, 2011 concerning the approval to be granted to managers of activities for children, young adults and families in distress ; and
      • defined by the general conditions (point 10 of the application file);
  • To carry out a procedure " selection-preparation-training " of maximum 30 hours with one of the foster care support services and obtain the selection certificate ;
  • Follow the basic training for foster families from 54 hours organized under the supervision of the Minister having in his attributions the childhood;
  • Follow for 12 hours per year at least, of the continuing education and/or supervision sessions ;
  • Understand and be able to express themselves in at least one of the 3 official languages of Luxembourg (German, French and Luxembourgish);
  • Be regularly monitored by one of the foster care support services;
  • Not to have been subject to criminal convictions incompatible with the exercise of this activity ;
  • The biological children of the foster family must not have been the subject of an educational assistance or placement measure within the meaning of the amended law of August 10, 1992 on youth protection or have been the subject of a foster care, stationary socio-educational care or socio-educational care abroad measure within the meaning of the law on assistance, support and protection for minors, young adults and families.

Procedures - Practicalities 

Introduction of the request

Anyone interested must fill out an application form for the socio-educational foster care activity: 
    • or via an online procedure on MyGuichet.lu ; 
    • or by downloading the specific form and sending it with the required documents by mail to

  •  The documents to be attached to the application for approval for the socio-educational foster care activity are the following:
    • Copy of the identity card of the member of the host family with primary responsibility for the child(ren); 
    • Current extended residence certificate (issued by the municipal administration) ; 
    • An extract of the criminal record bulletin number 3 "extract of classic criminal record" and an original of the criminal record bulletin number 5 related to the "protection of minors" dated 3 months, of the person having the main responsibility of the reception of the child or children and of the adult persons forming part of the household; 
    • Certificate of selection-preparation issued by one of the three accompanying services; 
    • Certificate of Participation in Basic Foster Care Training; 
    • Copy of the court order regarding the placement of the minor(s) if the foster family is already fostering a child/children.

If the file is incompleteThe Compliance Department of the General Directorate for Child and Family Welfare of the Ministry of Education, Children and Youth: 

  • Requests the missing documents from the person concerned; and
  • Provides referrals to foster care support services if the person does not already have one. 

If the file is completeThe department's Children's Aid Service:

  • sends an acknowledgement of receipt to the person concerned; and
  • makes referrals to foster care support services if the person does not already have one. 

 

Selection procedure

The person concerned must then contact the chosen support service in order to complete the "selection - preparation" procedure of a maximum of 30 hours and inform the Compliance Department of the General Directorate of Child and Family Welfare of Ministry of Education, Children and Youth.

Upon completion of the "selection - preparation" procedure, and in case of favorable selectionthe person concerned receives a selection certificate from the selected service.

Upon receipt of the selection certificate, the Compliance Department has a period of 3 months to assess the conditions of reception. This control is done on the basis of :

  • of thefile review application form and
  • from visits to the person's home.

In no response from Ministry of Education, Children and Youth within 3 months, the approval is considered granted.

Granting of approval

If approval is granted, this may include:

  • of a conditional approvali.e. provisionalwith a duration of 6 months to 2 years ;
  • of a unconditional approvali.e. final. It is granted to the person concerned if all conditions are met.

Note that the holder of a conditional approval can obtain an unconditional approval at any time, and vice versa.

L'recognition agreement as a child welfare service is delivered to the person concerned by the Minister.

From this point on, the person concerned can take in one or more children, and receives compensation costs and maintenance costs funded by the National Children's Office (ONE).

Compensation for foster care activity

 

The socio-educational foster care activity in day and/or night foster families is financed by the Office national de l'enfance (ONE) in the form of daily lump sums due for the days the child or young adult spends in foster care.

This lump sum is composed, if necessary, of maintenance costs and compensation, the amounts of which are fixed by the Amended Grand-Ducal Regulation of August 17, 2011 specifying the funding of child and family welfare measures.

Billing and payment is done monthly.
